1. Copyright
All designs are the property and copyright of Dwynwen and may not be reproduced by the Client or any third parties without prior written consent from Dwynwen. Any improper or illegal use of the stationery, artwork or designs will be pursued. The Client is responsible for ensuring that any material provided for inclusion in their stationery does not breach any third party Copyright, and the Client indemnifies Dwynwen against any action brought against the business in the event of any such breach.
2. Booking, Invoicing & Payments
Advanced bookings are confirmed by the Client's payment of a non-refundable £50 booking fee and the Client's agreement of the terms detailed within this contract. The Client will then be issued with dates for a production slot. This booking fee is then deducted from the Client's balance invoice when the production slot commences.
Upon commencement of the Client's production slot, the Client will be issued with a balance invoice for their order. Payment of this invoice is due in full prior to Dwynwen commencing the design process. In the case of any changes made by the Client to their order during the design process that impacts the order value, then the Client will be issued with a further invoice if there is an increased cost, payable once artwork has been agreed and there will be no further changes.
Payments are currently accepted via bank transfer.
3. Pricing
Pricing is supplied to the Client by Dwynwen during the enquiry process. Current pricing for the majority of products can also be viewed on Dwynwen's website.
Dwynwen reserves the right to amend pricing at any time.
4. Proofing
All proofs will be uploaded to the Client's portal. The information included within the design is to be provided by the Client. As such, it is the responsibility of the Client to proof read and check the spelling, grammar, punctuation, the correctness of any information before approving the proof and giving Dwynwen instruction to print.
Dwynwen does not take responsibility for any designs which are signed off and subsequently printed with typing or layout errors and will therefore not be liable for any resulting costs. Dwynwen therefore strongly advises that you check your stationery thoroughly before approval.
Please note that the colours that you see on your screen will vary from the printed results due to the difference between the digital display of colour on a lit screen and the colouring of ink on paper. We therefore cannot guarantee an exact match to a specific colour swatch. Dwynwen strongly advises a dark ink colour of all text to ensure legibility; as advised within the Client's Order Questionnaire. Should the Client insist on a lighter colour for text, Dwynwen does not take responsibility for illegibility or printing issues that arise from the Client's decision.
Proofs will be provided to the Client in the design that they have chosen. Dwynwen offers the Client two rounds of amendments/two additional proofing rounds in addition to the initial proof to allow the Client opportunity to make minor changes to wording or colour palette, or correct any errors. Amendments to proofs should be made within a reasonable timeframe to ensure that the Client's order can be completed within their production slot. Dwynwen does not accept responsibility for any orders that experience a delay in delivery due to untimely communication during the proofing process. Should the Client wish to change their choice of collection during the proofing process, then this will account as one of their proofing rounds. Should a Client's amendment request be deemed by Dwynwen as a signifcant, bespoke change to the chosen design, then additional charges may apply.
5. Delivery
Orders will be dispatched to the Client unassembled by default. Should the Client wish for their order to be assembled by Dwynwen, then this will occur an additional fee.
We deliver using Royal Mail Special Delivery service or courier services and a signature will be required on delivery. Alternatively, you may collect your order from us - please arrange an appointment with us to do this so that we can make sure we're available to greet you.
6. Handfinishing
Items such as hand-died silk ribbon, hand-assembled wax seals or any other product that requires hand finishing may vary due to their handmade nature. This is to be expected and is not deemed as faulty.
7. Usage
Dwynwen reserves the right to use your order for promotional purposes, including but not limited to; online through Dwynwen's website and social media channels, and during wedding fayres, showcases and events. Dwynwen will refrain from publicly promoting the Client's wedding stationery until either the Client has given consent, or the Client's wedding date has surpassed; whichever of the two is earliest. However, Dwynwen does reserve the right to share 'behind the scenes' imagery or footage across our social media channels, which may include sightings of the Clients order, in part of in its entirety, during the production process.
When sharing the Client's order with others, the Client's name and wedding details (examples include, but are not limited to; the venue name and location, ceremony time and wedding date) may be visible in any imagery or footage. Dwynwen will not clearly show the Client's contact information such as their address, email address or telephone number in interest of the Client's privacy.
8. Cancellation
In the case of full cancellation:
As Dwynwen provides a personalised product that cannot be reused or resold, cancelled orders following the Client's approval of the final proof cannot be refunded. Should the Client choose to cancel their order entirely once design work has started and proofs have been exchanged but prior to final approval, then a 50% refund will be issued.
In the case of partial cancellation:
Should the Client choose to reduce the value of their order by cancelling pre-agreed items or make any other decisions that subsequently reduces the value of their order below their original balance paid, then the Client will be refunded for the value of cancelled items up to a maximum refund of 50% of the original order value. The Client remains liable for 50% of the original order value, despite the amount of items cancelled.
9. Force Majeure
Dwynwen will not be liable if we are unable to operate our services as agreed due to events that are beyond our reasonable control. This may include, but is not limited to; act of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods, epidemics and pandemics); loss of utilities (such as, but not limited to, electricity, gas, water); war, hostilities (whether war be declared or not), invasion, act of foreign enemies, mobilisation, requisition, or embargo; rebellion, revolution, insurrection, or military or usurped power, or civil war; contamination by radio-activity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radio-active toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly; riot, commotion, strikes, go slows, lock outs or disorder; acts or threats of terrorism.
10. Termination
Dwynwen reserves the right to terminate this agreement with immediate effect if the Client is in breach of any of the terms or fails to make payment when due. Dwynwen reserves the right to cancel an order at any time.
